1) Introduction & Agreement

These Terms & Conditions (“Terms”) govern your access to and use of the website, content, and services of Visaportal.org (“Visaportal,” “we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy.

Visaportal is a private, third-party travel documentation/visa assistance service. We are not a law firm and do not provide legal advice. We are not affiliated with any embassy, consulate, immigration department, or government agency (including but not limited to the US Department of State, US Department of Homeland Security, or USCIS). Official forms may be available at no cost from government websites. Our paid Services cover expert preparation support, document review, and customer assistance.

Nothing in these Terms limits any non-waivable rights you may have under applicable US law.

2) Eligibility & Your Responsibilities

You must be at least 18 years old (or the age of majority where you live) to use the Services. You represent and warrant that:

  • All information you submit is true, accurate, current, and complete.

  • You have lawful authority to provide any personal data or documents submitted to us (including on behalf of another person) and have obtained all required consents.

  • You understand our role is limited to assistance with preparation and facilitation. You are solely responsible for reviewing and approving all materials before submission.

3) No Legal Advice; No Attorney-Client Relationship

We are not a law firm and our materials/support do not constitute legal advice. Your use of the Services does not create an attorney-client relationship. If you require legal advice, consult a licensed attorney in your jurisdiction.

4) Service Scope & Government Processes

We assist with preparing, organizing, and (when applicable) facilitating submission of visa/travel authorization documents. We cannot influence government processing times, appointment availability, or outcomes. All decisions remain with the relevant authority.

Government fees, biometric fees, courier charges, medical exams, translations, and other third-party costs are separate from our fees and are non-refundable (see §14 and the Refund Policy).

5) Electronic Communications, E-SIGN Consent & Signatures

By using the Services, you consent to receive electronic communications (updates, notices, receipts) and you agree that electronic signatures/records satisfy legal requirements under the US Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state laws. You authorise Visaportal to:

  • Use electronic records and obtain electronic signatures as needed.

  • Assign a unique email address/alias to your file to receive official notices relevant to your application, where operationally necessary.

You may withdraw consent at any time by emailing [email protected]; withdrawal will stop Services that require electronic communications/signatures.

6) Language

Most materials are provided in English. Any translations are for convenience only. If there is any conflict, the English version controls.

7) Accounts & Security

If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use or security issue.

8) Our Review & Your Final Approval

Our review is limited to completeness, spelling, and internal consistency (names, dates, addresses). You agree to carefully review all application materials and acknowledge you are solely responsible for their content.

9) Your Content & Permissions

You warrant that any documents/data you submit do not infringe third-party rights and that you have obtained all necessary permissions. You grant Visaportal a limited, non-exclusive licence to use such content solely for providing the Services.

10) Intellectual Property

All site content, software, and trademarks are owned by Visaportal or its licensors and protected by US and international laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or extract source code except as allowed by law.

11) Acceptable Use

You agree not to:

  • Provide false or misleading information.

  • Upload malware or harmful code.

  • Interfere with or disrupt the Services.

  • Use automated access (scrapers/bots) without written consent.

  • Resell or sublicense the Services without permission.

We may monitor, suspend, or terminate access for suspected violations (see §20).

12) Pricing, Fees & Payment

Our current fees are shown at checkout or in your order confirmation. Prices may change for future purchases. Unless expressly stated otherwise:

  • Government and third-party fees are separate and non-refundable.

  • Your bank or payment provider may charge transaction/gateway fees.

13) Reviews & Testimonials

We may request feedback or reviews. By submitting feedback, you grant us permission to use it (in whole or part) for marketing/quality purposes, together with limited identifiers (e.g., first name and initial, product purchased, general location, age range), unless you opt out in writing. Individual results vary; testimonials do not guarantee outcomes.

14) Refunds, Credits & Chargebacks

Our Refund Policy is incorporated by reference. In summary:

  • Refunds may be available only before review or submission to an authority, per the Refund Policy.

  • Government fees, biometric fees, third-party costs, and completed Services are non-refundable.

  • If a material error is caused by us, we will re-submit at no additional Visaportal fee.

  • Initiating a chargeback outside the Refund Policy may be treated as a payment dispute; we reserve all rights to contest such disputes and provide documentation to processors/authorities.

15) Disclaimers

To the maximum extent permitted by law:

  • The Services are provided “as is” and “as available.” We do not warrant uninterrupted or error-free operation.

  • We do not promise appointment availability, processing times, or visa outcomes (all controlled by third-party authorities).

  • While we strive for accuracy, content may not reflect the latest policy/law changes.

Some jurisdictions do not allow certain disclaimers; if so, the foregoing applies to the fullest extent permitted by law.

16) Limitation of Liability

To the fullest extent permitted by law:

  • Visaportal and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for lost profits, revenue, goodwill, or data, arising from or related to the Services or these Terms.

  • Our aggregate liability for any claim is limited to the amount you paid to Visaportal for the relevant Service.

Some states do not allow limitations/exclusions of certain damages; if so, this limitation applies to the maximum extent permitted.

17) Indemnification

You agree to indemnify, defend, and hold harmless Visaportal and its officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your misuse of the Services; (b) your breach of these Terms; (c) your violation of law or third-party rights; or (d) content/data you provide.

18) Third-Party Services, Links & Gateways

Our Services may integrate with third parties (payment processors, couriers, translators, analytics, schedulers, etc.). Your use of those services is subject to their terms and privacy policies, and we are not responsible for their acts/omissions. Links to non-Visaportal sites are for convenience; no endorsement is implied.

19) US Government Notices & Non-Affiliation

Neither Visaportal nor Visaportal.org is affiliated with the US Department of State, US Department of Homeland Security, USCIS, or any other US or foreign government agency. Government authorities may change eligibility criteria or revoke travel authorizations. Submitting false information can lead to administrative/criminal penalties.

20) Monitoring, Suspension & Termination

We may, but are not obligated to, monitor use. We may suspend or terminate your access where we reasonably believe you have breached these Terms, engaged in fraud/abuse, or where required for security, maintenance, or legal reasons. Termination does not affect rights/obligations accrued up to termination.

21) Force Majeure

We are not liable for delay/failure due to events beyond our reasonable control, including acts of God, natural disasters, epidemics/pandemics, war, terrorism, labor disputes, government actions, utility failures, or internet disruptions. If such an event continues more than 60 days, we may terminate affected Services without liability.

22) Changes to Services or Terms

We may update the Services and these Terms from time to time. Changes take effect upon posting with an updated “Last modified” date. Your continued use after changes constitutes acceptance.

23) US Consumer Rights & Complaints

If you have concerns, contact us at [email protected]. You may also have rights under federal/state consumer protection laws (e.g., FTC Act, state UDAP statutes). Certain states provide additional consumer remedies; these Terms are not intended to waive non-waivable statutory rights.

24) Good-Faith Dispute Resolution

Before formal proceedings, the parties will attempt to resolve disputes in good faith. Either party may send written notice describing the dispute and proposed resolution. Senior representatives will confer within 14 days. If unresolved after 30 days, either party may proceed under §25.

25) Governing Law, Venue & Arbitration; Class Waiver

Governing Law & Venue. These Terms and any dispute are governed by the laws of the State of Delaware, without regard to conflicts-of-law rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware for any matter not required to be arbitrated.

Arbitration Agreement (Individual). To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Services (collectively, “Disputes”) shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules (including, where applicable, the Consumer Rules). The seat and venue of arbitration shall be Wilmington, Delaware. The language shall be English. The tribunal shall consist of one arbitrator with relevant subject-matter expertise. Judgment on the award may be entered in any court with jurisdiction.

Class/Representative Waiver. YOU AND VISAPORTAL AGREE THAT ARBITRATION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, NO CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDINGS ARE ALLOWED. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.

If a court holds the class waiver unenforceable, the entire arbitration agreement shall be unenforceable, and Disputes shall proceed in court (venue as above).

26) Time Limits for Claims

To the fullest extent permitted by law, any claim arising out of or relating to the Services must be brought within one (1) year after the claim accrues.

27) Privacy & Data Protection

Our Privacy Policy explains how we collect, use, disclose, and protect personal information, including any operational email-status tracking for support/billing security. By using the Services, you consent to such processing consistent with the Privacy Policy.

28) Right to Refuse Service

We reserve the right to refuse service where permitted by law, including in cases of suspected fraud, breach of these Terms, abusive behavior, or legal/compliance risk.

29) Severability; No Waiver

If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permissible, and the remainder will remain in full force. Our failure to enforce any right is not a waiver.

30) Assignment

You may not assign or transfer your rights or obligations without our prior written consent. We may assign our rights/obligations in whole or part, including in connection with a merger, acquisition, or sale of assets.

31) Entire Agreement

These Terms, together with any order confirmation, the Refund Policy, and the Privacy Policy, constitute the entire agreement between you and Visaportal and supersede all prior or contemporaneous understandings.
